Article 1 โ Purpose and Scope
This Acceptable Use Policy (hereinafter the "AUP") defines the rules governing the use of the services, networks, servers and infrastructure provided by North Hosting Canada Inc (12051672 Canada Inc), hereinafter "North Hosting Canada".
The AUP applies to all customers, users, resellers and any person accessing North Hosting Canada services, directly or indirectly. Use of the services implies full and complete acceptance of this policy.
The AUP supplements the Terms and Conditions and the Terms of Service of North Hosting Canada. In the event of a conflict, the more restrictive provisions shall prevail.
Article 2 โ Prohibited Activities
The following activities are strictly prohibited on all North Hosting Canada services and infrastructure. This list is non-exhaustive:
2.1 Illegal Content
- Hosting, storing, distributing or making accessible any content that is illegal under the laws of Canada, the Province of Quรฉbec or any applicable jurisdiction;
- Hosting or distributing child sexual exploitation material (CSAM), in accordance with sections 163.1 and 172.1 of the Code criminel (L.R.C. 1985, ch. C-46). Any such content will be immediately removed and reported to the competent authorities, including the Canadian Centre for Child Protection;
- Hosting content that incites hatred, violence or discrimination within the meaning of section 319 of the Code criminel.
2.2 Malicious Activities and Intrusions
- Accessing or attempting to access without authorization any computer system, network, account or data (hacking), in violation of section 342.1 of the Code criminel;
- Distributing, installing or executing malicious software (viruses, Trojans, ransomware, worms, rootkits, keyloggers);
- Conducting phishing, identity theft or social engineering activities;
- Launching or facilitating denial-of-service attacks (DoS/DDoS);
- Scanning ports, networks or vulnerabilities without prior written authorization from the owner of the target system;
- Intercepting or monitoring network communications without authorization.
2.3 Intellectual Property Infringement
- Hosting, distributing or making accessible content that infringes copyright, trademarks or any other intellectual property rights, in violation of the Loi sur le droit d'auteur (L.R.C. 1985, ch. C-42);
- Operating pirated file-sharing services or counterfeit websites.
2.4 Cryptocurrency Mining
- Running cryptocurrency mining software on shared hosting, reseller hosting or any service not expressly authorized for this purpose;
- Cryptocurrency mining is only permitted on dedicated servers and VPS, subject to prior written authorization from North Hosting Canada and compliance with applicable resource limits.
2.5 Other Prohibited Activities
- Operating open proxy or open relay services;
- Hosting illegal gambling websites;
- Using the services to conduct fraudulent or deceptive activities;
- Circumventing security measures or access restrictions implemented by North Hosting Canada.
Article 3 โ Resource Usage Limits
Customers must use server resources (CPU, memory, bandwidth, disk space, processes, simultaneous connections) in a reasonable manner and in accordance with the limits of their plan.
- Shared hosting: Resource usage must not affect the performance of other customers sharing the same server. North Hosting Canada reserves the right to suspend or limit accounts that consume excessive resources;
- VPS and dedicated servers: Usage is limited to the resources allocated to the subscribed plan. Persistent overuse may result in additional billing or a mandatory upgrade;
- Bandwidth: Bandwidth usage must comply with the plan terms. Abusive bandwidth usage (e.g., mass file distribution) may result in throttling or suspension;
- Storage: Disk space must be used for files directly related to the operation of the hosted website or service. Using disk space as a personal file storage or archiving solution is prohibited on shared hosting plans.
Article 4 โ Email Policy
Sending emails from North Hosting Canada services is subject to the following rules, in accordance with the Loi canadienne anti-pourriel (LCAP, L.C. 2010, ch. 23), also known as CASL:
- Mandatory consent: Any commercial electronic message (CEM) must be sent only to recipients who have given their express or implied consent, in accordance with sections 6 to 10 of the LCAP;
- Sender identification: Each CEM must clearly identify the sender, include the business contact information (name, mailing address, phone number or email address) and contain a functional unsubscribe mechanism;
- Unsubscribe mechanism: Every CEM must contain a clear and functional unsubscribe mechanism. Unsubscribe requests must be processed within ten (10) business days;
- Spam prohibition: Sending unsolicited bulk emails (spam), using purchased or harvested mailing lists without consent, and any form of spam are strictly prohibited;
- Sending limits: Shared hosting plans are subject to hourly email sending limits. Exceeding these limits may result in a temporary suspension of the email service.
Warning: Violations of the LCAP may result in administrative monetary penalties of up to $10,000,000 for corporations. North Hosting Canada fully cooperates with the CRTC in any spam-related investigation.
Article 5 โ Network Abuse
The following activities constitute network abuse and are strictly prohibited:
- Launching or participating in distributed denial-of-service (DDoS) attacks or any form of attack aimed at disrupting the operation of a network, server or service;
- Spoofing IP addresses (IP spoofing) or network packet headers;
- Exploiting network or software vulnerabilities to gain unauthorized access;
- Using North Hosting Canada services as a platform for launching attacks against third-party systems;
- Interfering with the normal operation of the North Hosting Canada network or third-party networks;
- Operating botnets or networks of compromised machines from the North Hosting Canada infrastructure.
North Hosting Canada actively monitors its network to detect abusive activities and reserves the right to take immediate action, including traffic filtering, service suspension or account termination, without notice.
Article 6 โ Consequences of Violations
Any violation of this AUP may result, at the sole discretion of North Hosting Canada, in one or more of the following measures:
- Warning: A written notice informing the customer of the violation and requesting corrective action within a reasonable timeframe;
- Temporary suspension: The immediate suspension of the affected service, with or without notice, depending on the severity of the violation. The service will be restored once the violation has been corrected;
- Account termination: The immediate and permanent termination of the customer's account, without refund of amounts already paid, in the event of a serious or repeated violation;
- Reporting to authorities: Reporting the illegal activity to the competent authorities, including the Royal Canadian Mounted Police (RCMP), the Sรปretรฉ du Quรฉbec, the Canadian Centre for Child Protection or any other relevant authority;
- Legal proceedings: Initiating civil or criminal proceedings against the offender.
Important: In the event of a violation involving child sexual exploitation material (CSAM), terrorist activities or any other serious criminal offence, North Hosting Canada will proceed with the immediate suspension of the service and report to the authorities without prior notice to the customer.
Article 7 โ Reporting Abuse
If you observe a violation of this AUP or if you are the victim of abuse originating from the North Hosting Canada infrastructure, please report it immediately:
When reporting, please include as much information as possible:
- The IP address or domain name involved;
- The date and time of the incident;
- A detailed description of the abuse observed;
- Any relevant evidence (screenshots, email headers, connection logs).
North Hosting Canada commits to acknowledging receipt of any abuse report within twenty-four (24) hours and to taking appropriate action as promptly as possible.
Article 8 โ Legal Framework of Reference
This AUP is established in compliance with the following laws and regulations:
- Code criminel (L.R.C. 1985, ch. C-46) โ in particular sections 163.1 (child pornography), 184 (interception of communications), 319 (incitement to hatred), 342.1 (unauthorized use of a computer), 430(1.1) (mischief in relation to computer data);
- Loi canadienne anti-pourriel (LCAP, L.C. 2010, ch. 23);
- Loi sur le droit d'auteur (L.R.C. 1985, ch. C-42);
- Loi sur la protection des renseignements personnels et les documents รฉlectroniques (LPRPDE, L.C. 2000, ch. 5);
- Loi sur la protection des renseignements personnels dans le secteur privรฉ (RLRQ, c. P-39.1) of Quรฉbec;
- Code civil du Quรฉbec (C.c.Q.).
Article 9 โ Amendments
North Hosting Canada reserves the right to amend this AUP at any time. Amendments will take effect upon publication on the Website. Continued use of the services after publication of the amendments constitutes acceptance of the amended AUP.
In the event of a substantial amendment, North Hosting Canada will endeavour to notify customers by email or by a notice on the Website within a reasonable timeframe.
